These Terms of Service ("Terms") govern your access to and use of the The Hidden Lobby Auto Checkout Service (the "Service") operated by The Hidden Lobby ("The Hidden Lobby," "we," "us," or "our"). By (a) creating an account on our platform, (b) checking the "I agree" box during registration, or (c) otherwise accessing or using the Service, you ("Customer," "you," or "your") agree to be legally bound by these Terms and our Privacy Policy, which is incorporated herein by reference.
If you are accessing or using the Service on behalf of a business or other legal entity, you represent that you have the authority to bind that entity to these Terms, and the terms "you" and "your" shall refer to that entity.
You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you are 18 years of age or older.
The Hidden Lobby operates an automated purchasing service for trading card games and collectibles. The Service enables The Hidden Lobby to monitor Retailer websites for product availability and, upon availability, use your Billing Account credentials to complete a purchase on your behalf. Product selections, store preferences, and Billing Account assignments are configured by you through the Service dashboard.
The Service is a concierge purchasing service only. The Hidden Lobby is not a reseller, broker, or retailer. Products purchased through the Service are purchased in your name, shipped to your address on file with each Retailer, and charged to your payment method on file at the time of purchase. The Hidden Lobby does not take title to, handle, or ship any products.
The Service is provided in The Hidden Lobby's sole discretion. We reserve the right to add, modify, or remove supported Retailers, products, and Service features at any time without notice.
BY AGREEING TO THESE TERMS, YOU EXPRESSLY AND IRREVOCABLY AUTHORIZE The Hidden Lobby TO ACCESS YOUR BILLING ACCOUNTS AND COMPLETE PURCHASES AT DESIGNATED RETAILERS ON YOUR BEHALF USING YOUR STORED CREDENTIALS AND YOUR PAYMENT METHOD ON FILE AT EACH RETAILER.
Specifically, you authorize The Hidden Lobby to:
This authorization remains in effect for each Billing Account you maintain in an active state within the Service. You may revoke authorization for a specific Billing Account at any time by removing or deactivating it from the Service dashboard. Revocation is effective prospectively only — it does not affect purchases already completed.
Each Product Selection you activate within the Service constitutes a standing purchase order for that product at any Retailer assigned to that selection. The Hidden Lobby will attempt to complete such purchase whenever the product becomes available at the assigned Retailer(s), unless and until you deactivate the selection.
You acknowledge that purchases made by The Hidden Lobby under this authorization are made at your direction and on your behalf. You are solely responsible for all purchase prices, taxes, shipping charges, and any other amounts charged to your payment method at the time of purchase.
To use the Service, you must create an account and verify your identity through Discord OAuth2. You agree to provide accurate, current, and complete information during registration and to update it as necessary to keep it accurate.
You are solely responsible for maintaining the confidentiality of your Service account credentials. You agree to notify The Hidden Lobby immediately at [email protected] if you become aware of any unauthorized use of your account. The Hidden Lobby is not liable for any loss or damage arising from your failure to protect your credentials.
One Service account may be created per Discord account. Creating multiple accounts to circumvent this limitation, to abuse the Service, or to manipulate checkout outcomes is strictly prohibited and may result in immediate termination of all associated accounts without refund.
You agree to provide only Billing Account credentials that you own and are authorized to use. You warrant that you have not obtained credentials from any third party without their express authorization.
You represent and warrant that all Billing Account credentials you provide are accurate and current, including that: (a) the email address and password for each Retailer account are correct; (b) the payment method on file at each Retailer is valid, unexpired, and has sufficient available credit or funds to cover any purchase that may be completed; and (c) the shipping address on file at each Retailer is accurate and deliverable.
The Hidden Lobby is not responsible for failed checkouts caused by: incorrect credentials; expired, declined, or limited-credit payment methods; account lockouts or security challenges imposed by Retailers; or any inaccuracy in your Billing Account information. If a checkout fails for any such reason, no Service Fee is owed for that attempt.
You acknowledge that providing Billing Account credentials to a third party (including The Hidden Lobby) may violate some Retailers' terms of service. You assume full responsibility for any consequences, including account suspension or termination by a Retailer, arising from your participation in the Service.
The Hidden Lobby charges a Service Fee of ten percent (10%) of the market price of each item at the time of purchase. The market price is determined by The Hidden Lobby in its reasonable discretion based on publicly available pricing data at the time the Checkout is completed.
The Service Fee is charged separately from, and in addition to, the Retailer purchase price charged to your payment method at checkout. You are responsible for paying both the Retailer purchase price (charged directly to your card on file at the Retailer) and the Service Fee (invoiced by The Hidden Lobby).
Service Fees are invoiced through your Service dashboard. You agree to pay all invoiced amounts within twenty-four (24) hours of invoice issuance. Late payments may result in suspension or termination of your account. The Hidden Lobby reserves the right to charge interest on overdue amounts at the maximum rate permitted by applicable law.
All Service Fees are non-refundable once a Successful Checkout has been completed. The Hidden Lobby does not issue refunds for Service Fees based on post-purchase price changes, the Customer's inability to resell an item, or any other reason unrelated to a The Hidden Lobby billing error.
You agree not to initiate a chargeback, dispute, or reversal with your payment provider for any Service Fee that was lawfully invoiced for a Successful Checkout. You acknowledge that initiating a fraudulent chargeback constitutes a material breach of these Terms and may result in immediate termination of your account and referral to collections.
The Hidden Lobby does not guarantee that any product will be successfully purchased. Checkout success depends on many factors outside The Hidden Lobby's control, including but not limited to:
The Hidden Lobby does not guarantee checkout speeds, checkout rates, or any particular level of service throughput. You acknowledge that automated checkout services are competitive by nature, and that no representation regarding likelihood of success has been made to you.
In the event a Retailer cancels an order after a Successful Checkout, the Service Fee already paid is non-refundable unless the cancellation was caused solely by The Hidden Lobby's error. If The Hidden Lobby's own error causes a failed or erroneous checkout, The Hidden Lobby's sole liability shall be to waive or refund the applicable Service Fee.
You acknowledge that automated purchasing may be prohibited under some or all Retailers' terms of service, and that using the Service may result in Retailer-side consequences including account warnings, purchase limits, cancellations, or permanent account suspension or termination.
The Hidden Lobby is not responsible for any Retailer-side actions taken against your accounts, including any loss of loyalty points, rewards balances, order history, or account access. You agree to hold The Hidden Lobby harmless from any such consequences.
You agree to comply with all applicable Retailer purchase limits and policies. You acknowledge that The Hidden Lobby may not be aware of all per-account or per-address purchase limits imposed by Retailers, and that exceeding such limits is your sole responsibility.
The Hidden Lobby makes no representation that the Service complies with any Retailer's terms of service. Your use of the Service is at your own risk with respect to each Retailer's policies.
You agree to use the Service only for lawful personal or business purposes. You shall not:
The Hidden Lobby reserves the right to refuse, suspend, or terminate Service to any Customer who violates these obligations or who The Hidden Lobby reasonably believes is using the Service in a harmful, fraudulent, or abusive manner.
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTY OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, The Hidden Lobby EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO: IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM A COURSE OF DEALING OR USAGE OF TRADE.
The Hidden Lobby DOES NOT WARRANT THAT (A) THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE; (B) ANY CHECKOUT ATTEMPT WILL SUCCEED; (C) PRODUCTS WILL BE AVAILABLE AT ANY PARTICULAR PRICE; OR (D) THE SERVICE WILL MEET YOUR SPECIFIC REQUIREMENTS OR EXPECTATIONS.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL The Hidden Lobby, ITS OWNERS, OPERATORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE TO YOU FOR:
EVEN IF The Hidden Lobby HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE EXTENT THAT The Hidden Lobby'S LIABILITY IS NOT EXCLUDED UNDER APPLICABLE LAW, The Hidden Lobby'S TOTAL AGGREGATE LIABILITY TO YOU ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE TOTAL SERVICE FEES PAID BY YOU TO The Hidden Lobby IN THE THIRTY (30) DAYS PRECEDING THE CLAIM.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. TO THE EXTENT APPLICABLE LAW PROHIBITS SUCH EXCLUSION OR LIMITATION, THE FOREGOING LIMITATIONS APPLY TO THE MAXIMUM EXTENT PERMITTED.
You agree to indemnify, defend, and hold harmless The Hidden Lobby and its owners, operators, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with:
These Terms remain in effect for as long as you maintain an active Service account. Either party may terminate the relationship at any time: you, by deleting your account; The Hidden Lobby, by suspending or terminating your access.
The Hidden Lobby may immediately suspend or terminate your account, without notice or refund, if The Hidden Lobby determines in its sole discretion that you have: (a) violated these Terms; (b) engaged in fraudulent, deceptive, or harmful conduct; (c) failed to pay outstanding invoices; or (d) created a legal, compliance, or reputational risk for The Hidden Lobby.
Upon termination, your right to access the Service ends immediately. Outstanding Service Fees invoiced prior to termination remain due and payable. Purchase authorizations for active selections will be cancelled, but any Checkout already in progress at the time of termination may be completed and invoiced.
Sections 4, 7, 11, 12, 13, 15, and 17 survive termination of these Terms.
The Service, including all software, designs, text, graphics, logos, and functionality, is owned by The Hidden Lobby and protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service solely for its intended purpose as described in these Terms.
You may not copy, reproduce, modify, distribute, or create derivative works from any part of the Service without The Hidden Lobby's prior written consent. "The Hidden Lobby" and the The Hidden Lobby logo are proprietary marks and may not be used without express written permission.
The Hidden Lobby reserves the right to modify these Terms at any time. We will notify you of material changes by posting a notice in your Service dashboard or by email. Your continued use of the Service after the effective date of any amendment constitutes your acceptance of the updated Terms.
If you do not agree to an amendment, your sole remedy is to discontinue use of the Service and delete your account before the amendment's effective date.
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. You agree that any dispute arising from these Terms or the Service shall be resolved exclusively by binding individual arbitration administered under the rules of a recognized arbitration body, and not by class action or jury trial. You waive any right to bring claims as a class action or in any representative capacity.
Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent irreparable harm, and The Hidden Lobby may pursue collection of overdue Service Fees through any available legal means.
